Terms of Service

Using Feral Club

• - Feral Club is referral and affiliate marketing software for Shopify brands. We help connect advocate and affiliate activity to real revenue outcomes.
• - You need an account to use the product. Keep your login secure and tell us if you think someone has accessed your account.
• - You are responsible for the accuracy of the information you provide and the activity that happens under your account.

Shopify connection

• - You may connect a Shopify store so Feral Club can sync store data and generate referral intelligence.
• - You confirm that you have permission to connect the store and authorize access to the Shopify data you make available.
• - If you disconnect a store, parts of the product may stop working because the data source is gone.

ReferralCandy migration

• - If you upload ReferralCandy exports, you confirm that you have permission to use that data.
• - We may use uploaded advocate data to match Shopify customers, create referral records, and help you move referral programs into Feral Club.
• - Review migration results before relying on them. CSVs can be messy. We will do our best, but you should still check the output.

Payments and trials

• - Paid plans, trials, and billing terms will be shown before you subscribe.
• - Unless we say otherwise, fees are charged in advance and are non-refundable except where required by law.
• - We may change pricing or plan limits in the future. If we do, we will give reasonable notice when the change affects an active subscription.

Acceptable use

• - Do not use Feral Club to break the law, violate Shopify terms, abuse customers, send spam, or interfere with the product.
• - Do not reverse engineer the product, attempt unauthorized access, or overload our systems.
• - Do not upload data you do not have the right to use.

Data and confidentiality

• - You own your store data. We use it to provide, secure, support, and improve Feral Club.
• - We will treat non-public business data as confidential and expect you to do the same with non-public Feral Club information.
• - Aggregated or de-identified insights may be used to understand product performance, as long as they do not identify you, your store, or your customers.

Product changes

• - Feral Club is evolving. We may add, change, or remove features as we learn what growth marketers actually need.
• - Some features may be beta, experimental, or not available to every account.
• - We are not building loyalty points, influencer tracking, or non-Shopify integrations yet.

Affiliate program

• - Merchants may invite advocates to become affiliates within their program. Both the merchant and the affiliate must explicitly accept this arrangement.
• - When a merchant invites an affiliate, Feral Club facilitates the presentation and acceptance of an affiliate agreement. That agreement is between the merchant and the affiliate — Feral Club is the platform facilitating it, not a party to it.
• - Affiliates accept their agreement through a timestamped click-through in the Feral Club portal. Acceptance records are stored and accessible to both parties.
• - Merchants are responsible for ensuring their affiliate agreements comply with applicable law, including FTC disclosure requirements.
• - In a future release, affiliates will be able to receive cash payouts through Stripe Connect. When that feature is available, additional terms, identity verification, and tax documentation requirements will apply. US-based affiliates earning over $600 per year may receive a 1099 form.
• - Feral Club is not responsible for disputes between merchants and affiliates about commissions, agreements, or promotional activity.

Disclaimers

• - Feral Club provides software and insights. We do not guarantee specific revenue, growth, attribution, fraud prevention, or customer behavior.
• - The product is provided as available. We work hard to keep it reliable, but no software is perfect.

Limitation of liability

• - To the fullest extent allowed by law, Feral Club will not be liable for indirect, incidental, special, consequential, or punitive damages.
• - Our total liability for claims related to the service will be limited to the amount you paid Feral Club in the 3 months before the claim, unless the law requires otherwise.

Ending the relationship

• - You can stop using Feral Club at any time.
• - We may suspend or terminate access if you violate these terms, create risk, or use the product in a way that harms Feral Club, customers, or partners.
